H1B is a non immigrant visa, and we dont have the full constitutional rights, for eq we dont have the right to vote.
Legally we are not immigrants, that is the worst mistake( calling ourselves immigrants) ,being done by us,
If USCIS denies GC for security reasons, you cant sue them.
It is not the U.S constitution or the constitutional law that is in question here. The lawsuit is being filed to simply determine if the laws were broken when this visa bulletin fiasco happened. If so, the courts will give relief. The laws of the U.S extend to everybody (citizens, GC holders and non-immigrants) who lives on the U.S soil.
It is just like how if a non-immigrant breaks a law, he/she is arrested and taken to court. Even the terrorists who are held in Gitmo won a lawsuit that they have a fair share in the courts. There are numerous cases of potential immigrants who sued the U.S govt and got GCs (most recent being a worker who got his I-140 rejection based on labor cert overturned in Washington State by a Federal Court and finally got his GC).
But, as you mentioned, there are certain aspects of the Constitution that apply only to Citizens. I don't think the constitutional law applies here.

This is a neat idea to draw worthwhile attention which at the same time won't cause any hatred. I'm sure most of us would like to act upon this.
Can one of core members talk to a florist and workout some kind of arrangement where if we call them and give a code and payment they would process the order with a pre-set message and delivery address. I'm sure we will have a large participation if we make the process simple for the mass.
Also make this a front page message.

I agree with you. No questions about it. I think there are two components on legal immigration alone:
1. People who are stuck in the queue for many years
2. Increase in visa numbers for future skilled workers
At minimum, number 1) above should be fixed out of fairness. We already went through the painful labor certification process. That's unrelated to market demand or not.
I agree, we haven't had a chance to put that clear message out there.
This myth has never been successfully countered in the media or any other PR or lobbying channel by the legal immigration crowd.
The standard line amounts to this:
We are highly skilled we are legal and we are stuck and dont deserve this.
This is not good PR. Nobody cares about this.. it will get us nowhere..
We need to have a standard message apart from all other humint crap..

Try to call them or you may write a letter to them. I really hope and pray you get your EAD card soon. I also had applied in June and received few days ago. Good Luck.

Hello All..
Can anyone throw some light on why some cases have not been receipted so far and are pending for any action..No rejections, no receipts no cheques ..nothing..
I see guys already starting to discuss EAD and opening companise etc..
We are still waiting for the ACK fron USICS...
My case was received at NSC on 18Th July by R cook, whose name I havent seen in this frum...and no info so far..Called USICS and talked to 2nd level clerk but no receipted so far.. so they have no info..

I asked my employer if they would tune the clauses to "1 yr after EAD" but they said NO - "it will be 1 yr after GC"
They also told me over phone that they have the capability of revoking
140 and complaining against me to INS if i try to leave before getting the actual GC.
Can they do that - after 6 months they lose that control - Right ??
Employer can revoke I-140 anytime until I-485 is approved. After 180 calendar days of I-485 filing date, employee can continue I-485 seeking AC-21 protection . Employee must have open permanent job offer from another employer. The new job must be same or similar.

Once you have created a "portfolio" with the SRC/EAD numbers... there will be atable with LUD dates. Soft LUD is just a LUD without any change in status message. Hard LUD is when there is an actual update in status.

First of all, its not between me and employer for that matter. USCIS is delaying the process with no logical reason ( am i repeating myself from my first post - hopefully you read again and properly this time Mr.confused ).
All we want is to have them follow a pattern. Wait what am i doing here, you are confused, doesnt matter what i write here. Let me know when you are normal ( after all the hormones are in order, if at all that happens ), we can talk.

This in fact will help us prepare our case even more stronger against USCIS. It is best we ourselves find all the gaps we might have while we proceed with this case instead of them coming onto the issue.
I would suggest everyone who ofcourse is in favor or in doubt to bring forward the issues they think we need to cover while we move on with this.

I take frequent trips to India and all of them are extremely satisfying, and many times the thought has crossed my mind about the possiblity of moving back but it will take some time for changes to happen for the good and that is because i think,
We, Indians have a basic mental flaw wherein we shy away from unpleasant confrontation regardless of the merits of our case or the adverse consequences that such inertia engenders. The net result is that we are unable to translate our moral convictions into practical reality allowing law abiding citizens to be held hostage to the tantrums of a belligerent and corrupt minority, who call the shots in most places, right from the bottom to the top , in any sphere or area...(rather than talent and merit that should call the shots )

GKBest, it takes minimum two days to appear on computer records for the customer care to tell you. My application was entered in system on 10th october but rep could only see it on 12th oct.
